Acceptance of Terms
By accessing or using Handpass, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform. Your continued use of Handpass constitutes acceptance of any updates or modifications to these terms.
User Accounts
You must create an account to access certain features of Handpass, and you are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. We reserve the right to terminate accounts that violate these terms or that have been inactive for an extended period.
Listings and Transactions
Sellers are solely responsible for the accuracy, completeness, and legality of their listings, including descriptions, photos, and pricing. All transactions are conducted directly between buyers and sellers; Handpass acts solely as a marketplace facilitator and is not a party to any agreement between users. Handpass does not guarantee the quality, safety, legality, or delivery of any items listed on the platform.
Prohibited Items
You may not list or attempt to sell items that are illegal, counterfeit, stolen, hazardous, or otherwise prohibited under applicable law. This includes but is not limited to weapons, controlled substances, regulated wildlife products, and items that infringe third-party intellectual property rights. Violations may result in immediate removal of listings and termination of your account.
User Conduct
You agree to use Handpass in a manner that is lawful, respectful, and consistent with these terms and our community guidelines. Harassment, fraud, impersonation, spam, and any other abusive behaviour are strictly prohibited on our platform. We reserve the right to investigate complaints and take appropriate action, including suspending or permanently banning accounts.
Intellectual Property
All content on Handpass, including its design, logos, text, and software, is the property of Handpass or its licensors and is protected by applicable intellectual property laws. By submitting content such as listing photos or descriptions, you grant Handpass a non-exclusive, royalty-free licence to use, display, and distribute that content in connection with operating the platform. You retain ownership of your content but warrant that it does not infringe any third-party rights.
Limitation of Liability
To the fullest extent permitted by law, Handpass and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability to you for any claim arising under these terms shall not exceed the greater of the fees you have paid to Handpass in the twelve months preceding the claim or one hundred Australian dollars. Some jurisdictions do not allow limitation of liability for certain types of damages, so these limitations may not apply to you.
Termination
We may suspend or terminate your access to Handpass at any time, with or without notice, for conduct that violates these terms or that we determine to be harmful to other users, third parties, or the platform. You may terminate your account at any time by contacting us or using the account deletion feature in the app. Termination does not affect any rights or obligations that arose prior to the termination date.
Changes to Terms
Handpass reserves the right to modify these Terms of Service at any time, and we will notify you of material changes via email or an in-app notice. Your continued use of the platform after changes become effective constitutes your acceptance of the revised terms. We encourage you to review these terms periodically to stay informed of any updates.
